Terms & Conditions
The terms that govern your use of our website and design services.
These Terms & Conditions ("Terms") govern your access to and use of the Eagle Gaming Arts (EGA) website and services. By accessing our website, submitting a brief, placing an order, or otherwise engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Who We Are
Eagle Gaming Arts, operating under the brand EGA ("we," "us," or "our"), is a brand and apparel design studio providing identity design, product graphics, print, large-format, and related digital services to clients in the United States, the United Kingdom, and worldwide.
2. Services
We provide design and production services including, but not limited to, brand identity, apparel design, custom design work, vector art, business cards, banners, vehicle wraps, packaging and labeling, product design, and related digital services such as web development, app development, SEO, social media management, and advertising. The specific scope of any project will be defined in the brief or order you submit and any written communication confirming that scope.
3. Quotes, Orders & Payment
- Quotes provided in response to a brief or order are estimates based on the information you provide. Final pricing may be adjusted if project requirements change after the quote is issued.
- Work begins only once a project is approved and, where applicable, any required deposit or payment has been received.
- Payment terms (deposit amount, milestone payments, or full payment) will be communicated at the time of quoting and must be honored according to the agreed schedule.
- We reserve the right to pause or withhold delivery of work if payment is overdue.
4. Turnaround & Revisions
- Estimated turnaround times are provided in good faith based on current workload and project complexity, and are not guaranteed delivery dates unless explicitly confirmed in writing.
- Revisions are included as part of our standard process to ensure the final work meets your requirements. Excessive revision requests beyond the reasonable scope of the original brief may incur additional charges, which will be communicated before proceeding.
- Delays caused by late feedback, incomplete information, or delayed file approval from the client may extend the original turnaround estimate.
5. Client Responsibilities
You are responsible for providing accurate, complete, and timely information, feedback, and approvals needed to complete your project. You are also responsible for ensuring that any content, logos, text, images, or materials you provide to us do not infringe on the intellectual property or other rights of any third party.
6. Intellectual Property & Ownership
- Upon full payment for a completed project, ownership of the final approved deliverables transfers to you, unless otherwise agreed in writing.
- We retain the right to showcase completed work in our portfolio, website, and marketing materials unless you request confidentiality in writing prior to project completion.
- Preliminary concepts, drafts, and unused design directions remain our intellectual property and are not licensed for your use unless separately agreed and paid for.
- Any third-party assets (stock photography, fonts, or licensed materials) used in your project remain subject to the terms of their original license, and it is your responsibility to maintain any required licenses for continued use.
7. File Uploads
When you upload files, sketches, or reference materials through our website, you confirm that you have the right to share those files with us and that they do not contain any harmful, illegal, or infringing content. We reserve the right to refuse or remove any submitted file that violates this requirement.
8. Cancellations & Refunds
- If you cancel a project after work has begun, you remain responsible for payment covering the work completed up to the point of cancellation.
- Deposits are generally non-refundable once work has commenced, as they cover time and resources already committed to your project.
- Refund requests will be reviewed on a case-by-case basis and are not guaranteed.
9. Limitation of Liability
To the fullest extent permitted by law, EGA shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services, including but not limited to loss of profits, revenue, or business opportunities. Our total liability for any claim arising from a project shall not exceed the amount paid by you for that specific project.
10. Third-Party Links
Our website may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or terms of any third-party site, and linking to them does not imply endorsement.
11. Website Use
You agree not to use our website in any way that could damage, disable, or impair it, or interfere with any other party's use of the website. You agree not to attempt to gain unauthorized access to any part of our website, systems, or networks.
12. Governing Law
These Terms are governed by the laws applicable in the jurisdiction relevant to the entity you are contracting with — either the United States or the United Kingdom, depending on where your project is being managed from. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in that jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The updated version will be posted on this page, and your continued use of our website or services following any changes constitutes acceptance of the revised Terms.
